For di case wey court never assign judge, Obasa dey beg court make dem talk say e impeachment no legal, say im colleagues no get right to remove am when di House still dey recess.
Di court papers wey im lawyer, Chief Afolabi Fashanu (SAN), file on February 12, 2025, show say 36 lawmakers vote comot Obasa for January 13, 2025, when e no even dey Nigeria. E say di action no follow constitution and di Lagos State House of Assembly rules.
Obasa dey ask court make dem:
- Rush di case so e go quick finish
- Give di defendants only seven days to reply
- Give am three days to answer any legal point dem raise
E base im argument on nine legal points, including di meaning of di 1999 Constitution (wey dem don amend) and di House rules. E talk say if House dey on recess, dem no fit do sitting unless di Speaker approve am, so di impeachment no valid.
Obasa dey tell court say di case urgent because e fit scatter di legislative process. E say di way dem take change leadership for Assembly no follow due process and di court fit fast-track di case.
On January 13, 2025, more than two-thirds of di 40 lawmakers vote remove Obasa because of misconduct and oda wahala. As e no dey, dem elect im deputy, Mojisola Meranda, as Speaker, wey make am di first woman wey don lead Lagos Assembly.
